Medinest ("Medinest", "we", "us") is the author and publisher of www.medinest.in and the mobile application "Medinest" (the "Platform"). Please read these Terms carefully before accessing or using our Platform or Services. By accessing the Platform, you irrevocably accept all conditions stipulated in this Agreement.

1. Nature and Applicability of Terms

Please carefully go through these Terms and Conditions ("Terms") and the Privacy Policy before you decide to access the Platform or avail the Services made available by Medinest. These Terms and the Privacy Policy together constitute a legal agreement ("Agreement") between you and Medinest in connection with your visit to the Platform and your use of the Services.

  • The Services may change from time to time at the sole discretion of Medinest.
  • By accessing the Platform, you irrevocably accept all conditions stipulated in this Agreement.

2. Conditions of Use

3. Terms of Use

3.1 End-User Account and Data Privacy

Medinest may collect personal information and sensitive data as defined under applicable laws, including device data, usage data, and health-related inputs.

  • The User agrees that all information provided is accurate and up to date.
  • Users are responsible for maintaining account confidentiality.
  • Any misuse of the account must be reported to Medinest immediately.
  • Medinest shall not be responsible for incorrect or false information provided by Users.
  • Medinest shall not be responsible for unauthorized access due to user negligence.
If information is found false or misleading, Medinest reserves the right to suspend access. Services are provided on an "as is" and "as available" basis without warranties of any kind.
3.2 Nature of Services

Medinest is a healthcare technology platform — not a hospital, clinic, diagnostic laboratory, or medical practitioner. Medinest facilitates access to independent third-party providers.

Important: Medinest does not provide medical advice, diagnosis, or treatment. No doctor-patient relationship is created between Medinest and the User.
3.3 Medical Disclaimer

Any information provided through the Platform is for informational purposes only. Users must consult qualified medical professionals before making any health decisions.

In case of emergencies, contact emergency services immediately. Do not rely solely on the Platform for urgent medical guidance.
3.4 Health Camps and Awareness Programs

Medinest may conduct health camps and awareness programs. Users acknowledge that screenings are preliminary, results are not a final diagnosis, and further consultation is required. Medinest is not responsible for decisions taken solely based on camp results.

3.5 Third-Party Services
  • Diagnostics & Labs: Medinest does not operate labs and is not responsible for accuracy or quality of results.
  • Doctor Consultations: Provided by independent practitioners. Medinest is not responsible for advice given or treatment provided.
3.6 Content Ownership

All content on the Platform belongs to Medinest. Users shall not copy, reproduce, or distribute any content for commercial purposes without prior written permission.

3.7 User Obligations
  • Do not post unlawful, harmful, or misleading content on the Platform.
  • Do not violate intellectual property rights of Medinest or third parties.
  • Do not attempt unauthorized access or hacking of the Platform.

Medinest may remove such content and terminate access without prior notice.

4. Health Records

Medinest may provide digital health records storage and management features.

  • Users are responsible for maintaining correct and up-to-date details in their health records.
  • Medinest may access records for support or legal compliance purposes.
  • Medinest uses reasonable security practices but does not guarantee complete protection against all threats.
  • Users may request deletion of their health records at any time by contacting support.

5. Rights and Restrictions

Users shall not:

  • Upload illegal or harmful content to the Platform.
  • Spread misinformation or false health-related claims.
  • Use the Platform for unauthorized commercial or non-intended purposes.

Medinest reserves the right to remove content, report violations to authorities, and terminate user accounts without prior notice.

6. Termination

Medinest may suspend or terminate your access if these Terms are violated or if fraud or misuse of the Platform is detected.

Upon termination, users will lose access to their accounts and all associated data stored on the Platform.

7. Limitation of Liability

Medinest shall not be liable for direct or indirect damages, medical outcomes, or third-party service failures arising from use of the Platform.

Maximum Liability: Medinest's total aggregate liability to you shall not exceed ₹1,000 (Indian Rupees One Thousand only) under any circumstances.

8. Data Retention

Medinest may retain user data as required by applicable law and operational needs. Data retention practices are subject to our Privacy Policy. Users may request data deletion where permitted by law.

9. Governing Law and Disputes

These Terms are governed by the laws of India. Any disputes arising shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana. Disputes shall be resolved by arbitration under the Arbitration & Conciliation Act, 1996.
